Not all agents are created equal and you need a qualified Short Sale agent to negotiate the best terms possible with your lender. Hiring the wrong agent can cause you delays and problems that can result in a foreclosure.

You want to be sure the REALTOR you hire has the experience you need but is not too busy to personally attend to your short sale process. A real estate agent or broker who uses an assistant to do most of the work on your short sale may not be your best choice. Always call your agent to see how quickly you can speak to them personally. If they are not quick to respond you may experience delays that can be frustrating.

A short sale means that the owner of a property owes more to their lender than the property is currently worth on the market. In this situation the seller can put the home up for sale but any offer received from a buyer must also pass through a short sale approval process with the seller’s lender. It may sound like it should be easy to do but in today’s environment it takes continuous follow up with the seller’s lender to be sure a short sale will actually close. California law provides certain protections for homeowner’s that may or may not apply to your situation. Some lenders will allow you to short sell your property but retain their right to pursue a deficiency judgment against you in the future. This situation can cause undue stress and financial hardship to someone who thought their financial liability for the property had concluded with a short sale. There is a new government programs called HAFA (Home Affordable Foreclosure Alternatives) that you may qualify for. This program took effect on April 5th 2010 and was designed to ease the burden of the short sale on all parties involved.

Though this is a great benefit to all parties you will still need the assistance of a short sale expert to complete the forms necessary for a pre-approved short sale.
